TERMS OF SERVICE
Last updated: August 20, 2026
These Terms of Service (“Terms”) govern access to ColorVanta.com and purchases made through the ColorVanta EU Store and US Store.
Please read these Terms before using the Website or placing an Order. By using the Website, you agree to comply with the provisions concerning Website access and use. When you place an Order, the version of these Terms in force at that time forms part of the contract between you and ColorVanta.
Nothing in these Terms excludes, restricts, or replaces any consumer right that cannot lawfully be excluded or restricted.
TABLE OF CONTENTS
1. SCOPE AND DEFINITIONS
These Terms apply to:
- the institutional Website at https://colorvanta.com/;
- the EU Store at https://colorvanta.com/eu/;
- the US Store at https://colorvanta.com/us/;
- all Orders placed through either regional Store.
In these Terms:
- “ColorVanta,” “we,” “us,” or “our” means the company identified in Section 21, trading under the ColorVanta brand;
- “Website” means ColorVanta.com, including the institutional Website and the regional Stores;
- “EU Store” means the Store intended for customers and delivery addresses within the European Union;
- “US Store” means the Store intended for customers and delivery addresses within the United States and Canada;
- “Store” means either the EU Store or the US Store, as applicable;
- “customer,” “you,” or “your” means the person accessing the Website or placing an Order;
- “consumer” means an individual acting for purposes outside that individual’s trade, business, craft, or profession;
- “Product” means a poster, art print, or other item offered for sale through a Store;
- “Order” means an order submitted through a Store;
- “Order Confirmation” means the email confirming that we have accepted an Order;
- “business day” means a day other than a Saturday, Sunday, or public holiday in the place where the relevant obligation is performed.
2. COLORVANTA AND THE REGIONAL STORES
ColorVanta is a brand operated by the company identified in Section 21.
The Website consists of one institutional Website and two regional online Stores:
- the EU Store, intended for customers in the European Union; and
- the US Store, intended for customers in the United States and Canada.
Each regional Store only accepts Orders for delivery within its designated region: the EU Store serves the European Union, and the US Store serves the United States and Canada.
The institutional Website contains information about ColorVanta, its collections, its Products, and its policies. Products are purchased through the appropriate regional Store.
3. ELIGIBILITY AND CUSTOMER ACCOUNTS
You may browse the Website without creating an account.
To place an Order, you must:
- have the legal capacity to enter into a binding contract;
- provide accurate and complete billing, contact, and delivery information;
- use a payment method that you are authorized to use;
- select the Store corresponding to the delivery destination.
Where the applicable law requires parental or guardian authorization, a minor may only place an Order with that authorization.
If you create an account, you are responsible for:
- keeping your login credentials confidential;
- maintaining accurate account information;
- notifying us promptly if you suspect unauthorized use of your account.
We may suspend or close an account where reasonably necessary to protect the Website, customers, or ColorVanta, or where the account is used unlawfully or in breach of these Terms.
4. PRODUCTS AND PRODUCT INFORMATION
ColorVanta offers original made-to-order Giclée Print Posters.
We aim to present each Product accurately through its images, description, dimensions, available formats, materials, technical details, price, and regional production information.
Before placing an Order, you are responsible for reviewing:
- the selected design;
- the selected size and format;
- the delivery destination;
- the billing and contact details;
- the total price displayed at checkout.
4.1 IMAGES AND COLORS
Product images are intended to represent the artwork and Product as accurately as reasonably possible. However:
- colors may vary slightly between screens and the physical print because of screen settings, device characteristics, ambient lighting, paper, ink, and printing processes;
- product mockups are illustrative and may not represent the exact physical scale of the Product in a particular room;
- frames and decorative accessories shown in mockups are not included unless expressly stated.
Reasonable differences that do not affect the Product’s conformity with the contract are not defects. This does not exclude your rights where the Product materially differs from its description, approved specifications, or other contractual requirements.
4.2 DIMENSIONS AND TOLERANCES
Dimensions are presented in the relevant Product page or selection interface. Small tolerances may occur in printing and trimming, provided they remain reasonable and do not materially affect the Product’s conformity or intended use.
4.3 AVAILABILITY AND CORRECTIONS
Products, sizes, or formats may become unavailable. We may correct obvious typographical, technical, pricing, or product information errors before accepting an Order.
If an error or unavailability is identified after an Order has been placed, we will contact you.
If we cannot supply the Product as ordered, you may either accept an alternative offered by us or receive a full refund for the affected Product.
5. MADE-TO-ORDER PRODUCTION AND REGIONAL FULFILLMENT
Products are made to order. Production generally begins shortly after payment and Order acceptance.
Made-to-order production allows Products to be created only when ordered, reducing unnecessary overproduction and stock waste.
ColorVanta uses a regional Store and fulfillment structure:
- Orders placed through the EU Store are printed, packaged, and shipped within the European Union;
- Orders placed through the US Store are printed, packaged, and shipped within North America for delivery within the United States or Canada.
The production and delivery process may be performed by specialized production and logistics partners acting on behalf of ColorVanta. The customer’s contract remains with ColorVanta, and the use of those partners does not remove any responsibility that applicable law places on us.
We do not guarantee a particular production facility, production partner, or country within the applicable region unless this is expressly stated for a specific Product or Order.
6. PRICES, TAXES, SHIPPING FEES, AND PAYMENT
6.1 REGIONAL CURRENCIES
Prices are displayed in the currency used by the relevant Store:
- the EU Store displays prices in euros;
- the US Store displays prices in United States dollars.
Your bank, card issuer, PayPal, or other payment provider may apply currency conversion or similar fees. Any such fees are charged by the provider, not by ColorVanta.
6.2 TOTAL PRICE AND TAXES
The total amount payable is displayed before you place the Order.
Prices include applicable taxes. No additional taxes are added at checkout.
6.3 FREE SHIPPING
Shipping is free for all destinations served by the relevant regional Store.
6.4 PAYMENT METHODS
Available payment methods are shown at checkout and may include:
- credit and debit cards;
- PayPal;
- other methods introduced in the relevant Store.
Payments are processed through third-party payment providers, including Stripe and PayPal. ColorVanta does not receive or store complete payment card details where those details are handled directly by the payment provider.
Payment must be successfully authorized before an Order can be accepted and produced.
7. ORDERS AND CONTRACT FORMATION
When you place an Order, you are offering to purchase the selected Products under these Terms.
Before submitting the Order, you will have an opportunity to review and correct the Order information shown at checkout.
After you place an Order, you will receive an Order Confirmation by email. The contract is formed when your payment has been successfully authorized and we send you that Order Confirmation.
The Order Confirmation and these Terms should be retained for your records.
We may refuse or cancel an Order before dispatch where reasonably necessary, including where:
- payment is not authorized;
- the Product is unavailable;
- there is an obvious pricing or product information error;
- the Order appears fraudulent, unlawful, or intended for unauthorized resale;
- technical or production circumstances prevent fulfillment.
If we cancel an Order after payment, we will refund the amount paid for the canceled Products using the original payment method.
8. ORDER CHANGES AND CANCELLATIONS
Because Products are made to order and production may begin shortly after Order Confirmation, requested changes or cancellations must be submitted as soon as possible to support@colorvanta.com.
We will make reasonable efforts to stop or change an Order before production begins, but we cannot guarantee that this will be possible.
Once production has begun:
- a non-EU Order generally cannot be changed or canceled merely because the customer changed their mind, subject to any mandatory local rights;
- an EU consumer retains the statutory right of withdrawal described in Section 10, unless a lawful exception applies.
Cancellation by ColorVanta is governed by Section 7.
9. SHIPPING, DELIVERY, AND RISK
Processing times, estimated delivery times, eligible destinations, shipping methods, and tracking information are described in our Shipping and Delivery Policy.
Delivery times are estimates. Delays may occur because of production volume, carrier operations, weather, public holidays, address issues, or other circumstances.
You must provide a complete and accurate delivery address. If an Order cannot be delivered because the address supplied is incorrect or incomplete, we may ask you to pay reasonable additional costs required for a new delivery, to the extent permitted by law.
For EU consumers, risk of loss or damage passes when you, or a third party designated by you other than the carrier, takes physical possession of the Product. In other jurisdictions, risk passes as required by applicable mandatory law.
If tracking indicates delivery but you have not received the Order, or if an Order appears lost or substantially delayed, contact us promptly at support@colorvanta.com.
We will investigate the issue with the production or delivery partner and provide the remedy required by applicable law.
Carrier delays or events beyond our control do not remove any mandatory right you may have to require delivery, terminate the contract after an appropriate additional period, or receive a refund.
10. EU RIGHT OF WITHDRAWAL
This Section applies to consumers who purchase through the EU Store for delivery within the European Union.
10.1 FOURTEEN-DAY WITHDRAWAL PERIOD
You have the right to withdraw from the purchase contract without giving a reason within 14 calendar days from the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the Product.
Where multiple Products from one Order are delivered separately, the period begins when you acquire physical possession of the last Product.
10.2 HOW TO EXERCISE THE RIGHT
To exercise the right of withdrawal, you must send us an unequivocal statement before the 14-day period expires.
You may exercise the right of withdrawal by emailing support@colorvanta.com.
The EU Withdrawal Notice in Section 22 provides further guidance, but no specific wording is required.
Please include the Order number and enough information to identify the Order.
We will acknowledge an electronic withdrawal request in a durable form, normally by email.
10.3 NO PHYSICAL RETURN REQUIRED
ColorVanta does not require the physical return of a Product when an eligible EU consumer exercises the statutory right of withdrawal described in this Section.
Do not send the Product to ColorVanta, any production or fulfillment partner, a shipping carrier, or any other address.
After we confirm the withdrawal, you may keep, donate, recycle, or otherwise dispose of the Product responsibly.
This no-return policy is more favorable to the consumer than the standard statutory return procedure. It does not restrict or replace the right of withdrawal.
10.4 REFUND FOLLOWING WITHDRAWAL
If you validly withdraw, we will refund the full amount paid for the withdrawn Products.
Shipping is free, so there is no separate delivery charge to refund.
The refund will be made:
- without undue delay;
- no later than 14 days after we are informed of your decision to withdraw;
- using the same payment method used for the original transaction, at no additional cost to you.
Because ColorVanta does not require a physical return under this policy, the refund will not be withheld pending receipt of the Product or evidence of return.
10.5 PERSONALIZED PRODUCTS
The right of withdrawal may not apply to a Product made according to the consumer’s individual specifications or clearly personalized for that consumer.
Choosing from standard designs, sizes, or formats offered in the Store does not, by itself, make a Product personalized.
10.6 RELATIONSHIP WITH DEFECTIVE-PRODUCT RIGHTS
The right of withdrawal is separate from your rights concerning damaged, incorrect, or non-conforming Products.
Sections 12 and 13 continue to apply even after the withdrawal period has ended.
11. RETURNS AND REFUNDS OUTSIDE THE EU RIGHT OF WITHDRAWAL
This Section applies to:
- customers purchasing through the US Store;
- customers who are not exercising the EU statutory right of withdrawal;
- situations not covered by a mandatory change-of-mind return right.
Because Products are made to order, ColorVanta does not generally accept returns or exchanges solely because:
- the customer changed their mind;
- the wrong standard size, format, or design was selected by the customer;
- the customer’s preferences changed after the Order was accepted.
This policy does not affect:
- any mandatory right under the law applicable to the customer;
- rights concerning Products that are damaged, incorrect, defective, or otherwise non-conforming;
- any additional remedy expressly offered in our Refunds Policy or Order Confirmation.
Do not send a Product to ColorVanta, or any production or fulfillment partner. Physical returns are not accepted unless mandatory law requires a return or ColorVanta expressly provides written return instructions for a specific case.
12. DAMAGED, INCORRECT, OR DEFECTIVE PRODUCTS
Please inspect the Product after delivery.
If the Product arrives damaged, is not the Product ordered, or appears defective, contact support@colorvanta.com as soon as possible after delivery so that we can investigate the issue promptly.
This does not limit any mandatory legal guarantee or conformity rights.
Please provide, where reasonably available:
- the Order number;
- a description of the issue;
- photographs of the Product;
- photographs of the packaging and shipping label where transport damage is involved.
Do not send the Product to ColorVanta, any production or fulfillment partner, a shipping carrier, or any other address. A physical return is normally not required.
Depending on the circumstances and applicable law, the remedy may include:
- replacement;
- repair, where appropriate;
- a proportional price reduction;
- a full or partial refund;
- another remedy required by mandatory law.
If a physical return is required, ColorVanta will provide instructions and cover any return costs required by applicable law.
13. LEGAL GUARANTEE AND CONFORMITY RIGHTS
Products must conform to the contract and to the requirements of applicable consumer law.
EU consumers have legal conformity rights under applicable European Union and national consumer law.
Depending on the applicable circumstances, these rights may include:
- repair or replacement free of charge;
- a proportional reduction in price;
- termination of the contract and refund;
- other remedies provided by mandatory law.
For a printed poster, repair may not be technically appropriate, in which case replacement or another lawful remedy may be used.
Consumers in the European Union retain any mandatory consumer protections applicable in their country of habitual residence.
Customers in the United States and Canada retain any consumer warranty rights that cannot legally be excluded or waived under applicable law.
Any commercial accommodation, voluntary refund, or replacement offered by ColorVanta is additional to, and does not reduce, mandatory legal rights.
14. INTELLECTUAL PROPERTY
Unless otherwise stated, all rights in the Website and its Content belong to ColorVanta or are used under authorization. This includes:
- artworks and designs;
- Product images and mockups;
- photographs;
- text and descriptions;
- collection names and presentation;
- branding, logos, graphics, and layout.
Purchasing a physical Product transfers ownership of that physical copy only. It does not transfer copyright, design rights, trademark rights, digital files, or any other intellectual property right.
You may display a purchased Product for personal use. Without prior written authorization, you may not:
- reproduce, scan, photograph for commercial reproduction, or create copies of the artwork;
- sell or distribute reproductions or derivative products;
- use the artwork in advertising, merchandise, templates, datasets, or digital products;
- remove or alter rights-management information;
- use ColorVanta branding in a way that suggests endorsement, partnership, or authorization.
Nothing in this Section prevents any use permitted by mandatory law.
15. WEBSITE USE AND PROHIBITED CONDUCT
You may use the Website for lawful personal or commercial-information purposes consistent with these Terms.
You must not:
- use the Website for unlawful, fraudulent, or abusive activity;
- attempt to gain unauthorized access to accounts, systems, or data;
- interfere with Website operation or security;
- introduce malicious code or conduct automated activity that places an unreasonable load on the Website;
- scrape, extract, reproduce, or republish substantial Website Content without authorization;
- impersonate another person or knowingly provide false information;
- misuse promotions, payment disputes, refunds, or customer-support processes;
- infringe intellectual property, privacy, or other legal rights.
We may take proportionate measures to prevent or respond to misuse, including restricting access, canceling fraudulent Orders, preserving evidence, and reporting unlawful activity.
16. PRIVACY AND COOKIES
Personal data is processed as described in our:
Those policies explain, among other matters, the categories of data processed, purposes, legal bases, recipients, retention, rights, and use of cookies or similar technologies.
Using the Website does not, by itself, constitute consent to the processing of personal data. Where consent is required by law, it will be requested separately.
17. THIRD-PARTY SERVICES
We use third-party service providers to operate the Stores and fulfill Orders. These may include:
- production and fulfillment providers;
- shipping carriers;
- Stripe, PayPal, and other payment providers;
- hosting, security, analytics, email, and technical providers.
A third party may apply its own terms directly to services it provides to you, such as a payment account or delivery redirection service.
Links to third-party websites are provided for convenience or operational purposes. We do not control unrelated third-party websites and are not responsible for their content or independent practices.
The use of production, payment, or delivery partners does not exclude ColorVanta’s responsibility to the customer where applicable law makes us responsible for the sale, conformity, delivery, refund, or other contractual obligation.
18. LIABILITY AND EVENTS BEYOND OUR CONTROL
18.1 MATTERS THAT ARE NOT EXCLUDED
Nothing in these Terms excludes or limits liability:
- for fraud or fraudulent misrepresentation;
- for willful misconduct or gross negligence where applicable law prevents limitation;
- for breach of mandatory consumer rights;
- for any other liability that cannot lawfully be excluded or limited.
18.2 CONSUMER LOSSES
For consumers, ColorVanta is responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or failure to use legally required care.
We are not responsible for loss or damage that:
- was not reasonably foreseeable when the contract was formed;
- results from inaccurate information supplied by the customer;
- results from misuse, improper handling, unsuitable display conditions, or alteration of the Product after delivery;
- results from using a Product purchased as a consumer for business or professional purposes.
This Section is subject at all times to mandatory law.
18.3 BUSINESS USERS
If you purchase primarily for business, resale, trade, craft, or professional purposes, then, to the maximum extent permitted by law:
- we are not liable for loss of profit, revenue, business, opportunity, goodwill, or anticipated savings;
- we are not liable for indirect or consequential loss;
- our aggregate contractual liability relating to an Order will not exceed the total amount paid for that Order.
These limitations do not apply to liability that cannot lawfully be limited.
18.4 EVENTS BEYOND REASONABLE CONTROL
We are not liable for delay or failure caused by an event beyond our reasonable control, including severe weather, natural disaster, war, civil disturbance, strike, carrier disruption, widespread network failure, government action, or major interruption affecting a production partner.
We will take reasonable steps to reduce the effect of the event and resume performance.
If the event causes a substantial delay or makes performance impossible, we may cancel the affected part of the Order and refund the corresponding amount.
Consumers retain any rights under mandatory law to allow an additional period for delivery, terminate the contract, or obtain a refund.
19. CHANGES, SEVERABILITY, AND ENTIRE AGREEMENT
19.1 CHANGES TO THESE TERMS
We may update these Terms to reflect legal, technical, operational, or business changes.
The revised version applies from the “Last updated” date shown at the top of the page.
Changes do not retroactively alter an Order already accepted, unless:
- the change is required by law;
- the change benefits the customer; or
- the customer expressly agrees.
19.2 SEVERABILITY
If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions continue to apply.
19.3 NO WAIVER
A delay or failure to enforce a right does not waive that right.
19.4 ENTIRE AGREEMENT AND ORDER DOCUMENTS
The contract for an Order consists of:
- these Terms;
- the relevant Product page and options selected;
- the Order details shown at checkout;
- the Order Confirmation;
- the Shipping and Delivery Policy;
- the Refunds Policy;
- any other policy expressly incorporated into the Order.
If there is a conflict:
- mandatory law prevails;
- a specific written term expressly agreed for the Order prevails over a general term;
- the Order Confirmation and selected Product details prevail over general Website information;
- these Terms prevail over a general policy, unless that policy expressly grants the customer an additional right.
The Privacy Policy and Cookies Policy govern personal data and cookies rather than the commercial terms of an Order.
20. GOVERNING LAW, COMPLAINTS, AND DISPUTE RESOLUTION
20.1 CUSTOMER SUPPORT AND COMPLAINTS
Please contact us first so that we can try to resolve any concern:
- Email: support@colorvanta.com
- Contact page: https://colorvanta.com/contact-us/
Include the Order number and a clear description of the issue.
20.2 GOVERNING LAW
These Terms and Orders are governed by Portuguese law, without prejudice to applicable European Union law.
If you are a consumer, this choice does not deprive you of any mandatory protections granted by the law of the country in which you habitually reside, where those protections apply regardless of the chosen law.
20.3 COURTS
Disputes may be brought before the courts having jurisdiction under applicable law.
Nothing in these Terms requires a consumer to bring proceedings exclusively before a court in Portugal where mandatory consumer law gives that consumer the right to use another competent court.
20.4 CONSUMER ALTERNATIVE DISPUTE RESOLUTION IN PORTUGAL
Consumers may have access to an authorized consumer alternative dispute resolution entity.
Where applicable, consumer disputes may be submitted to:
Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL)
Website: https://www.centroarbitragemlisboa.pt/
Under Portuguese law, certain low-value consumer disputes are subject to mandatory arbitration or mediation when the consumer expressly chooses to submit the dispute to an authorized consumer arbitration center.
A current list of authorized consumer dispute resolution entities in Portugal is available from the Portuguese Directorate-General for Consumer Affairs:
https://www.consumidor.gov.pt/ral-mapa-e-lista-de-entidades
20.5 ELECTRONIC COMPLAINTS BOOK
Consumers may submit a complaint through Portugal’s Electronic Complaints Book:
